  1. INTRODUCTION
    1. GIBBY is operated by PT. Gibby International Group (individually and collectively also called "GIBBY" or "us"). GIBBY complies with applicable laws and regulations on privacy (the "Privacy Act") and is committed to respect the rights and privacy issues of all GIBBY Application Users ("Application"). We acknowledge the importance of the personal data that you have entrusted to us and believe that it is our responsibility to properly manage, protect and process your personal data. This Privacy Policy ("Privacy Policy" or "Policy") is designed to help you understand how we collect, use, disclose and / or process personal data that you have entrusted to us and / or we have about you, both today and in the future, and to help you make the right decision before giving your personal data to us.
    2. "Personal Data" means data, whether correct or not, about individuals that can be identified from such data, or from other data and information that can or may be accessed by an organization. Common examples of personal data are names, identification numbers, email, and contact information.
    3. By using GIBBY Application and/or registering an account with us, you acknowledge and agree that you accept the practices, requirements and/or policies described in this Privacy Policy, and you hereby permit us to collect, use, disclose and/or process your personal data as described here. IF YOU DO NOT ALLOW THE PROCESSING OF YOUR PERSONAL DATA AS EXPLAINED IN THIS PRIVACY POLICY, PLEASE DO NOT USE OUR APPLICATION. If we change our Privacy Policy, we will post these changes or the Privacy Policy that has been changed to our Application and/or via email. We reserve the right to change this Privacy Policy at any time.

  2. WHEN WILL GIBBY COLLECT PERSONAL DATA?
    1. We will/may collect your personal data:
      1. when you register and/or use our Application, or open an account with us.
      2. when you submit any form, including, but not limited to, application forms or other forms relating to our products and services, both online and in physical form;
      3. when you make an agreement or provide documents or other information regarding your interactions with us, or when you use our application;
      4. when you interact with us, such as through phone calls (which may be recorded), letters, faxes, face-to-face meetings, social media platforms and e-mail;
      5. when you use our electronic services, or interact with us through our application or use services on our site. This includes, but not limited to, through cookies that we may use when you interact with our application or website;
      6. when you make transactions through our Application;
      7. when you submit criticism and suggestions or complaints to us;
      8. when you register for a contest; or
      9. when you submit your personal data to us for any reason.
      The above list is not intended as a complete list and only sets out some general examples of when your personal data might be retrieved.
    2. When you visit, use or interact with our application, we may collect certain information automatically or passively using a variety of technologies, where the technology might be downloaded to your device and maybe set or change the settings on your device. The information we collect can include, without limitation, Internet Protocol (IP) addresses, operating systems and types of browsers of computers / mobile devices, types of mobile devices, characteristics of mobile devices, unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device, referring site address (if any), and pages that you visit on our website and mobile application and number of visits. We can only collect, use, disclose and or process this information for the Purposes as defined below.
    3. GIBBY may collect the right information about the location of your mobile device using technology such as GPS, Wi-Fi, etc. We collect, use, disclose and/or process this information for one purpose or more including, but not limited to, the location-based services that you requested or to send content that is relevant to you based on your location or to allow you to share your location with other Users as part of GIBBY services. For most mobile devices, you can withdraw your permission for us to obtain information about your location through the settings on your device. If you have questions about how to disable location services for your mobile device, please contact your mobile device service provider or your mobile device manufacturer.

  3. WHAT PERSONAL DATA WILL BE COLLECTED BY GIBBY?
    1. Personal data that GIBBY collects including but not limited to:
      • name;
      • email address;
      • Date of birth;
      • home or shipping address;
      • bank account and payment information;
      • phone number;
      • gender;
      • any other information about the User when the User registers to use GIBBY, and when the User uses GIBBY, as well as information related to how the User uses GIBBY; and
      • all data about the content used by the User.
    2. If you do not want us to collect the personal information / data mentioned above, you can opt out at any time by notifying us in writing about it. However, it should be noted that by withdrawing permission for us to collect, use or process your personal data, it may affect your use of the Application. For example, opting out of gathering location information will cause the location-based feature to be disabled.

  4. CREATE ACCOUNTS
    To use certain functions of our Application, you must create a user account that requires you to submit certain personal data. When you register and create an account, we require you to provide us with your name, contact number, and email address as well as the username you selected.. We also ask for certain information about yourself such as shipping address, photo identification, bank account details, age, date of birth, gender and your interests. After activating the account, you will select a password for your username. Your username and password will be used so that you can access and manage your account safely.

  5. BROWSING THE WEBSITE
    Just like most websites, your computer sends information that may include personal data about you that is recorded by the web server as you explore our Site. This usually includes but not limited to the computer's IP address, operating system, your browser name / version, referring webpage, requested page, date / time, and sometimes "cookies" (which can be disabled using your browser preferences) to help the site remember your last visit. When you log in, this information is associated with your personal account. Information is also included in anonymous statistics to enable us to understand how visitors use our site.

  6. COOKIES
    1. From time to time we may implement "cookies" or other features to enable us or third parties to collect or share information that will help us improve the quality of GIBBY Application, or help us offer new services and features. "Cookies" are identifiers that we transfer to your computer or software that allow us to recognize your computer or device and tell us how and when services or websites are used or visited, by how many people and track movements in our website. We can link cookie information to personal data. Cookies are also linked to information about the items you have chosen to buy and the pages that you have seen. This information is for example used to monitor your shopping cart. Cookies are also used to send content that suits your interests and monitor website usage.
    2. You may refuse the use of cookies; however, please note that if you do this, you may not be able to use the full functionality of our Application.


  7. SEE AND DOWNLOAD CONTENT AND ADVERTISING
    Just like when browsing web pages, when you see content and advertisements and access other software in the GIBBY Application, a portion of the same information is sent to us (including, but not limited to, IP Address, operating system, etc.); but rather than how many times the page is viewed, your computer sends us information about content, advertisements viewed and/or software installed by the Application and website and time.

  8. CUSTOMER SERVICE
    We provide customer service support via email, phone and feedback forms. In order to provide customer support, we will ask for your email address and your mobile number. We will only use information received from customer support requests, including, but not limited to, email addresses, for customer support services and we do not transfer or share this information with any third party.

  9. SURVEYS
    From time to time, we may request information from Users through surveys. Participation in this survey is entirely voluntary and therefore you have the choice to disclose your information to us or not. The information requested can include, but not limited to, contact information (such as your email address and phone number), and demographic information (such as interests or age levels). Survey information will be used for the purpose of monitoring or increasing the use and satisfaction of the Application and will not be transferred to third parties, other than our contractors who help us manage or follow up the surveys.

  10. HOW DO WE USE THE INFORMATION YOU GIVE TO US?
    1. We may collect, use, disclose and/or process your personal data for one or more of the following purposes:
      1. consider and/or process your application / transaction with us or your transaction or communication with third parties through GIBBY;
      2. managing, operating, providing and/or managing your use and/or access to the GIBBY Application, as well as your relationship and your user account with us.
      3. managing, operating, handling, providing to you and facilitating the procurement of our Application services to you, including, without limitation, remembering your preferences;

      9. maintain and provide any software updates and/or other updates and support that may be needed from time to time to ensure the smooth running of our Application;
      10. dealing with or facilitating customer service, carrying out your instructions, dealing with or responding to any questions raised by you or on your behalf;
      11. contact you or communicate with you through telephone calls, text messages and / or fax messages, emails and/or postal mail or other means for the purpose of managing and/or managing your relationship with us or your use of our Application, such as but not limited to communicating administrative information to you relating to our Application. You acknowledge and agree that such communication by us can be done by sending a letter, document or notification to you, which may involve disclosure of certain personal data about you to make the shipment;
      12. notify you when another User has sent a private message to you or posted a comment for you on our Application;

      15. if you give us your prior consent for marketing and in this case, to send you postal mail, e-mail, location-based services or otherwise, marketing and promotional information and materials relating to products and / or services (including , with no limitation to, third party products and/or services that may work with or be bound by GIBBY) that may be sold, marketed or promoted by GIBBY (and/or its affiliates or related companies), whether the product or service already exists now or created in the future.
      16. respond to legal processes or comply with or as required by any law, government requirement or applicable regulation with relevant jurisdictions, including, without limitation, meeting the requirements for disclosure based on legal requirements that bind GIBBY or a related company or its affiliate;
      17. produce statistics and research for internal and required reporting by law and/or archival storage requirements;
      18. carry out due diligence or other screening activities (including, without limitation, background checks) in accordance with legal or regulatory obligations or our risk management procedures that may be required by law or that have been enforced by us;
      19. audit GIBBY Application or business;
      20. prevent or investigate any fraud, illegal activities, omissions or errors, whether related to your use of our Application by you or any other matter arising from your relationship with us, and whether there is any suspicion about the above or not;
      21. save, organize, back up (whether for recovery after a disaster or other matter) of your personal data, whether within or outside your jurisdiction;
      22. dealing with / and or facilitating business asset transactions or the possibility of a business asset transaction, where the transaction involves GIBBY as a participant or only involving a related company or GIBBY affiliate as a participant or involving GIBBY and/or a related company or GIBBY affiliate or more as a participant, and maybe there are also other third party organizations that are participants in the transaction. "Business asset transactions" refers to the purchase, sale, lease, merger, consolidation or form of acquisition, release or financing of an organization or part of an organization or business or any asset of an organization; and/or
      23. any other purpose that we will notify you when obtaining your consent.
        (collectively referred to as "Purpose").

    2. Because we will/may collect, use, disclose or process your personal data depending on the situation at hand, these objectives may not be listed above. However, we will notify you of such other purposes when obtaining your consent, unless the processing of data that applies without your consent is permitted by the Privacy Act.

  11. SHARING INFORMATION FROM THE SERVICE

    Our services allow Users to share their personal information with each other, on almost all occasions without the involvement of GIBBY, to complete the transaction. In ordinary transactions, Users can have access to names, user IDs, email addresses and other contact information and posts from other users. Our Terms of Service require that Users who have other User personal data ("Receiving Parties") must (i) comply with all applicable Privacy Laws; (ii) allow other Users ("Expressing Parties") to remove themselves from the database of the Receiving Party; and (iii) allow the Disclosing Party to review what information has been collected about them by the Receiving Party.

  12. HOW DOES GIBBY PROTECT CUSTOMER INFORMATION?

    We implement various security measures to ensure the security of your personal data on our system. User personal data is behind a secure network and can only be accessed by a small number of employees who have special access rights to the system. We will store personal data in accordance with the Privacy Law and/or other applicable law. Therefore, we will destroy or anonymize your personal data as soon as it is natural to assume that (i) the purpose of the personal data collected is no longer achieved by the storage of such personal data; and (ii) storage is no longer needed for any legal or business purposes. If you stop using GIBBY, or your permission to use our Application is terminated, we can continue to save, use and/or disclose your personal data in accordance with this Privacy Policy and our obligations under the Privacy Act. Subject to applicable law, we can safely dispose of your personal data without prior notice to you.

  13. DOES GIBBY EXPRESS INFORMATION COLLECTED FROM VISITORS TO OUTSIDE PARTIES?
    1. In conducting our business, we will / may need to disclose your personal data to third party service providers, agents and / or affiliates or related companies, and / or other third parties. Third party service providers, agents and / or affiliates or related companies and / or other third parties will process your personal data on behalf of us or other parties, for one or more of the Objectives mentioned above. These third parties include, without limitation:
      1. our subsidiaries, affiliates and related companies;
      2. contractors, agents, service providers and other third parties that we use to support our business. This includes but is not limited to those who provide administrative or other services to us such as postal services, telecommunications companies, information technology companies and data centers;
      3. other buyers or successors in the event of a merger, divestment, restructuring, reorganization, dissolution or sale or other transfer of some or all of GIBBY's assets, either on an ongoing basis or as part of bankruptcy, liquidation or similar processes, in which personal data owned by GIBBY about our Users is one of the assets transferred; or to partners in a business asset transaction involving GIBBY or one of its affiliates or related companies; and
      4. the third party to whom we disclose the data for one or more Purposes and the third party will in turn collect and process your personal data for one or more Purposes

    2. This may require, among other things, sharing statistical and demographic information about our Users and their use of Application Services to advertising and programming vendors. This will not include anything that can be used to identify you specifically or find personal information about yourself.
    3. For the avoidance of doubt, in the event that a Privacy Law or other applicable law allows an organization such as us to collect, use or disclose your personal data without your consent, the permission granted by that law will continue to apply.
    4. Third parties may intercept or access personal data sent to or stored on the site without permission, technology may be malfunctioning or not work as expected, or someone may access, use or misuse information without error from our side. However we will use reasonable security arrangements to protect your personal data as required by the Privacy Act; but inevitably, there is no absolute guarantee of security as but not limited to unauthorized disclosures arising from dangerous and sophisticated hacking by parties who are displeased or hostile without any fault on our part.


  14. INFORMATION ABOUT MINORS
    Services are not intended for children under 10 years of age. We do not knowingly collect or store any personal data or non-personal information from anyone under the age of 10 and any other part of our Site or Services GIBBY is not intended for children under 10 years of age. We will close every account that is used exclusively by these children and will issue and/or delete any personal data that we believe is sent by children under 10 years of age.

  15. INFORMATION COLLECTED BY THIRD PARTIES
    1. Our site uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies, which are text files placed on your computer, to help websites analyze how Users use the Site. Information generated by cookies about your use of the website (including your IP address) will be sent to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your access of the website, compiling reports on website activities for website operators and providing other services related to website activities and Internet use.     2. We, and third parties, from time to time can provide downloads of software applications for you to use on or through GIBBY. This application can access separately, and allow third parties to view your identification information, such as your name, your user ID, your computer's IP address or other information such as cookies that you may have previously installed or installed for you by a software application or site third party web. In addition, this application can ask you to provide additional information directly to third parties. Third party products or services provided through this application are not owned or controlled by GIBBY. You are advised to read the terms and conditions issued by these third parties on their website or elsewhere.


  16. SECURITY AND THIRD PARTY SITES
    1. WE DO NOT GUARANTEE THE SECURITY OF PERSONAL DATA AND/OR OTHER INFORMATION YOU PROVIDE IN THIRD PARTY SITES. We implement various security measures to safeguard the security of your personal data that we have or are under our control. Your personal data is behind a secure network and can only be accessed by a small number of people who have special access rights to the system, and are required to maintain the confidentiality of that personal data. When you place an order or access your personal data, we offer secure server usage. All personal data or sensitive information that you provide is encrypted into our database only to be accessed as mentioned above.
    2. In an effort to give you better value, we may choose various third-party websites to link and frame in the GIBBY Application. We can also participate in joint branding and other relationships to offer e-commerce and other services and features to our visitors. The site of this link has a separate and independent privacy policy and security policy. Even if the third party is affiliated with us, we have no control over the site of the link, and each of these sites has privacy and data collection practices that are separate from us and stand alone. Data collected by our partners in joint branding or third party websites (even if offered on or through our Application) may not be accepted by us.
    3. Therefore we are not responsible for or have any liability for the content, security settings (or lack thereof) and the activities of these linked sites. This linked site is only for your convenience and therefore you access it at your own risk. However, we strive to protect the integrity of our Site and each of the links placed and therefore we welcome any feedback about these linked sites (including, without limitation, if certain links do not work).


  17. HOW CAN YOU REMOVE, ASK FOR ACCESS OR CHANGE THE INFORMATION YOU HAVE GIVEN TO US
    1. Revoking Agreement
      1. You may revoke your consent to the collection, use and/or disclosure of your personal data that we have or are under our control by sending us an email.
      2. After we receive clear revocation instructions from you and verify your identity, we will process your request for revocation of consent, after which we will not collect, use and / or disclose your personal data in the manner listed in your request.
      3. However, revocation of your consent may cause certain legal consequences arising from the revocation.       3. For requests to correct personal data, after we have enough information from you to handle requests, we will:
        1. correct your personal data within 30 days. If we cannot do it within that time frame, we will tell you when we can do the correction soonest. Please note that requests for corrections for certain types of personal data may not be permitted by the Privacy Act and there are certain situations where corrections need not be made by us even though there is a request from you; and
        2. we will send personal data that has been corrected to any other organization where such personal data has been disclosed by us one year before the date of correction, unless the other organization does not need personal data that has been corrected for legal purposes or any business .
      4. We will also/may charge you a reasonable fee for handling and processing your request to access your personal data. If we choose to charge a fee, we will provide an estimate of the costs we will charge you in writing. Please note that we are not required to respond to or handle your access request unless you have agreed to pay the fee.
      5. We have the right to refuse to correct your personal data in accordance with the provisions contained in the Privacy Act, if the provision requires and/or gives the right to an organization to refuse to correct personal data in the stated situation.
